Dentist couple Rajesh and Nupur Talwar were on Tuesday sentenced to life term by a CBI court after they were convicted of killing their daughter Aarushi and domestic help Hemraj five-and-a-half years ago.


49-year-old Rajesh and Nupur(48) were spared the death penalty by Additional Session Judge Shyam Lal who rejected the CBI plea for maximum punishment after the premier probe agency submitted that the case fell in the "rarest of rare" category.

Arguing before the court on quantum of punishment in the sensational double murder that had gripped the nation as one of the most puzzling crimes ever, CBI counsel R K Saini argued that the killing was a cold-blooded murder and fell in the "rarest of rare" category.

Defence counsel Tanvir Mir countered CBI's argument and said the evidence against his clients were weak and sought leniency for Talwars.

The arguments lasted just five minutes before the judge adjourned proceedings and pronounced he quantum of sentence at 4.30 PM.

The Talwar couple remained composed. The Talwar couple were also sentenced for five years for destruction of evidence and Rajesh for another one year for filing wrong FIR with police. All the sentences pronounced by the judge, who relied heavily on the circumstantial evidence provided by the CBI, will run concurrently.

The dentist couple were yesterday convicted in the murder of their 14-year-old daughter Aarushi and 45-year-old Hemraj in a case that was awash with allegations of sleaze and sex, police-goof-ups, CBI flip-flops and media bias.

The judge also made a reference to freaks in the history of mankind who kill their own progeny.

The couple was convicted under IPC sections 302(murder), 201(destruction of evidence) and 34(common intention to commit the crime).

Rajesh was also convicted separately for "furnishing false information to the police regarding the murder of his daughter by Hemraj(Section 203).

According to the CBI, the dentist killed Aarushi and Hemraj at their Noida home on May 15-16 night, 2008, in a fit of rage after finding them in an objectionable position. It says Nuput helped in the crime.

Rajesh's brother Dinesh yesterday said they would definitely appeal against the conviction in the Allahabad High Court.

"The fight has just begun. It will continue," he said, adding a lot of evidence has been ignored.

According to the CBI, the Talwars killed Aarushi in a fit of rage after finding her with Hemraj, who hailed from Nepal, in an "objectionable position", suggesting the double-murder could be case of honour killing.

Aarushi was found on her bed with her throat slit on the morning of November 1, days before the birthday of the class nine student, at their residence in Noida, a Delhi suburb.

Police initially blamed the missing domestic servant Hemraj-only to find his decomposing body on the roof 24 hours later with a similar cut and head wounds.

"Now is the time to say omega in this case, to perorate it is proved beyond reasonable doubt that the accused or the perpetrators of the crime in question.

"The parents are the best protectors of their own children. That is the order of the human nature but there have been freaks in the history of mankind where the father and the mother became the killer of their own progeny".

"They (Talwars) have extirpated their own daughter who hardly had seen 14 summers of her life and the servant without the compunction of terrestrial terrain in the breach of commandment 'thou shall not kill' and injunction of Holy Quran 'take not life which god has made sacred'," the judge, who is due to lay down office this month-end, said in his 204-page verdict yesterday.

Rajesh was arrested by Noida Police after the then Inspector General Gurdarshan Singh alleged that the father had murdered his daughter.

Later, he came out on bail after the case was handed over to the CBI.

Ironically, the CBI, which was handed over the case within a fortnight of the murders, initially gave Talwars a clean chit and pinned the blame on three domestic helps -Krishna, Rajkumar and Vijay who were arrested.

However, the CBI could not file a chargesheet in the stipulated three months time paving the way for their release on bail.

The then CBI Director A P Singh was of the opinion that no case was made against the three domestic helps and constituted a new team to probe the case afresh.

The CBI later filed a closure report saying though there was enough suspicion about the role of the parents in the murder, they had no direct evidence to prove it.

The CBI judge took on record the closure report and after perusing it, decided to press murder charges against the couple.
Oldest 'shrine' discovery suggests Buddha lived in 6th Cen BC

Archaeologists have unearthed the earliest ever 'Buddhist shrine' at Buddha's birthplace in Nepal, which suggests the sage may have lived in the 6th century BC, two centuries earlier than thought.


Excavations within the sacred Maya Devi Temple at Lumbini in Nepal, a UNESCO World Heritage site long identified as the birthplace of the Buddha, uncovered the remains of a previously unknown sixth-century BC timber structure under a series of brick temples.

This is the first archaeological material linking the life of the Buddha - and thus the first flowering of Buddhism - to a specific century, according to the research co-led by Robin Coningham from Durham University, UK. The timber structure contains an open space in the centre that links to the nativity story of the Buddha himself - his mother Queen Maya Devi gave birth to him while holding on to a tree branch within the Lumbini Garden.

The researchers suggest the open space in the centre of the most ancient, timber shrine may have accommodated a tree.

Geoarchaeological research also confirmed the presence of ancient tree roots within the temple's central void, according to the study published in the journal Antiquity.

Until now, the earliest archaeological evidence of Buddhist structures at Lumbini dated no earlier than the third century BC, the time of the patronage of the Emperor Asoka, who promoted the spread of Buddhism, from present-day Afghanistan to Bangladesh.

"Very little is known about the life of the Buddha, except through textual sources and oral tradition. Some scholars have maintained that the Buddha was born in the third century BC," lead researcher, Coningham from Durham University's Archaeology Department, said.

There is dispute over the birth date of Buddha, many scholars believe that the sage lived and taught in the 4th century BC and died at the age of 80. "Now, for the first time, we have an archaeological sequence at Lumbini that shows a building there as early as the sixth century BC," Coningham said.

Coningham, worked with Kosh Prasad Acharya from the Pashupati Area Development Trust in Nepal and an international team of archaeologists. To determine the dates of the timber shrine and a previously unknown early brick structure above it, researchers tested fragments of charcoal and grains of sand using a combination of radiocarbon and optically stimulated luminescence techniques.

The discovery contributes to a greater understanding of the early development of Buddhism as well as the spiritual importance of Lumbini, researchers said.

"These discoveries are very important to better understand the birthplace of the Buddha," said Ram Kumar Shrestha, Nepal's minister of culture, tourism and civil aviation.

"The government of Nepal will spare no effort to preserve this significant site," Shrestha said in a statement released by Durham university.

Lost in the jungles of Nepal in the Medieval period, ancient Lumbini was rediscovered in 1896 and identified as the birthplace of the Buddha on account of the presence of a third-century BC sandstone pillar. The pillar, which still stands, bears an inscription documenting a visit by Emperor Asoka to the site of the Buddha's birth as well as the site's name - Lumbini.

Gautama Buddha, also known as Siddhartha Gautama, or simply the Buddha, was a sage on whose teachings Buddhism was founded. He renounced the world at the age of 29 to seek enlightenment.

Summary and Highlights


Delhi Election Watch (DEW) and Association for Democratic Reforms (ADR) have analysed the self-sworn affidavits of 796 candidates out of 810 candidates who are contesting in the Delhi State Assembly Elections. (Detailed reports in English and Hindi are attached with this mail)
Criminal:

·         Candidates with Criminal Cases:Out of the 796 candidates analysed, 129 candidates (or 16%) have declared criminal cases against them. In 2008 Delhi Assembly elections there were 111 (14%) candidates with declared criminal cases out of 790 candidates analysed.
·         Candidates with Serious Criminal Cases:Out of the 129 candidates who have declared criminal cases, 93 (12%) have declared serious criminal cases. These include attempt to murder, robbery, dacoity and crime against women.
·         Party wise Candidates with Criminal Cases:15 (21%) of 70 candidates fielded by INC have declared criminal cases against them while 31 (46%) out of 68 candidates from BJP, 14 (21%) out of 67 candidates from BSP and 5 (7%) out of 70 candidates from AAP have declared criminal cases in their affidavits.
·         Party wise Candidates with Serious Criminal Cases: 8 (11%) of 70 candidates fielded by INC have declared serious criminal cases against them while 22 (32%) out of 68 candidates from BJP, 12 (18%) out of 67 candidates from BSP and 5 (7%) out of 70 candidates from AAP have declared serious criminal cases in their affidavits.
·         Party –wise Comparison of Candidates with Criminals Cases with 2008 Assembly Elections: INC had 30% candidates with criminal cases in the 2008 Assembly Elections which has gone down to 21% in the 2013 Assembly Elections. BJP had 35% candidates with criminal cases in the 2008 Assembly Elections which has risen to 46% in 2013 Assembly Elections. BSP had 23% candidates with criminal cases in the 2008 Assembly Elections which has gone down to 21% in 2013.
·         Red Alert Constituencies*: 14 constituencies have at least 3 candidates from these political parties with declared criminal cases.*Red Alert Constituencies are those which have 3 or more candidates with criminal cases standing up for elections. This analysis excludes independent candidates with criminal cases.
·          Cases of Attempt to Murder and related charges: 1 candidate has declared charges relating to causing death by negligence (IPC 304A) and 3 candidates have declared charges related to attempt to commit culpable homicide (IPC 308) against themselves while 10 candidates declared attempt to murder charges.
·          Cases related to Robbery and Dacoity: 3 candidates have declared robbery or dacoity related charges against them.
·          Crimes against Women: 13 candidates have declared crimes against women. 9 of these 13 candidates have declared charges related to assault or criminal force to woman with intent to outrage her modesty(IPC Section-354). 1 candidate has declared case related to husband or relative of husband of a woman subjecting her to cruelty (IPC Section – 498A) and one candidate declared a case of causing miscarriage without woman’s consent (IPC Section-313)
Financial:

·         Crorepati Candidates:Out of the 796 candidates analysed, 265 (33%) are crorepatis. In 2008 Delhi Assembly elections there were 180 (23%) crorepati candidates out of 790 candidates analysed.
·         Average Assets:The average asset per candidate contesting in the 2013 Delhi Assembly Elections is Rs.3.43 Crores. Average asset per candidate in 2008 Delhi Assembly elections was Rs.1.77 crores.
·         Party-wise Average Assets:Among major parties, the average asset per candidate for INC is Rs 14.25 crores, BJP candidates have an average assets of Rs.8.16 crores while the average assets of AAP candidates is Rs. 2.51 crores.
·         High Asset Candidates:Manjinder Singh Sirsa of SAD from Rajouri Garden constituency has declared highest assets worth Rs.235.51 crores followed by Sushil Gupta of INC from Moti Nagar constituency with declared assets worth Rs.164.44 crores and Ashok Kumar Jain of INC from Delhi Cantt constituency with declared assets worth Rs.143.69 crores.
· ·         Undeclared PAN: 117(15%) out of 796 candidates analysed have not declared their PAN details.

  • Average Asset growth in 5 years (2008-2013): The average asset growth for these 66 re- contesting MLAs, between the Delhi Elections of 2008 and 2013 is Rs 7.53 Crores.

·         Highest growth In Assets in 5 years (2008-2013): Sat Prakash Rana of BJP from Bijwasan constituency has declared maximum increase in assets with an increase of Rs 105.51 Crores i.e from Rs 6.38 Crores in 2008 to Rs. 111.89 Crores in 2013 (Sat Prakash Rana has not declared the value of two vehicles in his 2008 affidavit) Assets of Ram Singh Netaji of INC from Badarpur constituency has increased by Rs 50.26 Crores, from Rs 8.44 Crores in 2008 to Rs 58.71 Crores in 2013. Assets of Tarvinder Singh Marwahof INC from Jangpura constituency have risen by Rs 27.99 Crores, from Rs 7.06 Crores in 2008 to Rs 35.05 Crores in 2013 (Insurance policy value and one vehicle value was not provided in his 2008 affidavit).

Other Background details (Education, Gender, Age):

Candidates Education:A total of 280 (35%) candidates out of 796 analyzed are graduates or have higher degrees. 479 (60%) candidates have educational qualification of 12th pass and below.

Candidates’ Age:A total of 556 (70%) candidates out of the 796 analyzed, have declared their age to be between 25 and 50 years. 216 (27%) candidates declared their age to be between 51 and 70 years. 10 candidates are in the age group of 71-80 years.


Women Candidates:Out of 796 candidates analyzed, only 69 (9%) women are contesting in the Delhi 2013 Assembly Elections. Among the major political parties, INC and AAP has fielded 6 women candidates each and 5 women are contesting under BJP ticket.

मोदी की लोकप्रियता से बौखलाई कांग्रेस

नई दिल्ली, 25 नवम्बर। भारतीय जनता पार्टी के प्रधानमंत्री पद के उम्मीदवार श्री नरेन्द्र मोदी पर बढ़ रहे आतंकी खतरे को लेकर राष्ट्रवादी शिवसेना ने गहरी चिंता जताई है और केन्द्र सरकार से उनकी सुरक्षा व्यवस्था बढ़ाए जाने की मांग की है।
पार्टी द्वारा जारी एक प्रैस विज्ञप्ति में पार्टी के राष्ट्रीय प्रमुख श्री जयभगवान गोयल ने कहा कि देश में हिन्दूवादी ताकतों के इकट्ठा होने और संपूर्ण देश में जनता द्वारा श्री नरेन्द्र मोदी को दिए जा रहे अपार जन समर्थन से हिन्दू विरोधी ताकतें बौखला गई हैं और वे श्री मोदी को अपने मार्ग से हटाना चाह रही है। उन्होनें कहा कि आए दिन खुफिया सूत्रों के हवाले से समाचार प्रकाशित हो रहे हैं कि दुनिया भर के तमाम खुंखार आतंकवादी संगठन श्री मोदी को निशाना बनाने की योजना बना रहे हैं। इसके बावजूद भी भारत सरकार उनके प्रति सुरक्षा को लेकर कोताही बरत रही है।
श्री गोयल ने कहा कि देश में आज श्री मोदी की लहर है जिसे लेकर कांग्रेस बौखला गई है और ऐसा प्रतीत हो रहा है कि वह खुद श्री मोदी की सुरक्षा में ढील देकर किसी अनहोनी घटना के इंतजार में है। उन्होंने कहा कि  वर्तमान में देश में जिस प्रकार से भाजपा उम्मीदवार श्री नरेन्द्र मोदी की लहर और कांग्रेस को लेकर जनता में आक्रोश फैला हुआ है उससे स्पष्ट है कि 2014 के चुनावों में हिन्दुस्तान में श्री मोदी के नेतृत्व में हिन्दुओं की ही सरकार बनेगी। उन्होंने कहा कि देश का बहुसंख्यक हिन्दू आज इस बात से काफी आहत है कि धर्म निरपेक्षता का ढोंग करने वाले कांग्रेस और उसके सहयोगी दल देशवासियों को जाति व धर्म के नाम पर बाटकर और भगवा आतंकवाद का भय दिखाकर देश के लागों को आपस में लड़वाती रही है और सत्ता हासिल करती आई है तथा हिन्दू वोटों के दम पर ही सत्ता हासिल करने के वावजूद हिन्दुओं का ही सर्वाधिक शोषण हुआ।
केन्द्र सरकार से मांग करते हुए श्री गोयल ने कहा कि सरकार श्री मोदी की सुरक्षा में कोई कोताही न बरते और उनकी सुरक्षा व्यवस्था के पुख्ता इंतजाम करें अन्यथा देश से हिन्दू विरोधी कांग्रेस का अस्तित्व ही मिट जाएगा।

New Delhi, 25th November 2013: Yash’s deadly bowling helped Government Boys Senior Secondary School No.2, Keshav Puram thrash St. Columbo Public School, Pitam Pura by 75 runs in a Group A Round 2 match of the Coca-Cola Cricket Cup under-16 inter-school tournament, played at Parmarth ground today.

St. Columbo Public School won the toss and opted to field first. Government Boys School managed to score 171 runs with the help of Amit Malik (37), Guddu (27) and Neeraj (24 not out). For St. Columbo Public School, Keshav Malik led the bowling attack with his three-wicket haul. He was well-supported by Rishav Kumar and Sachin Nanda, whose two-wicket hauls helped their team to bowled-out the opposition in 28.2 overs.

While chasing, St. Columbo were bundled-out at a meagre score of 96. Govt. Boys School’s star bowler Yash spearheaded the bowling attack and his five-wicket haul rattled the opponent’s batting line-up. From the other end, Amit and Ajay Pal claimed two wickets and helped their team to contain St. Columbo in 19.4 overs.

Yash was adjudged Man-of-the Match for his lethal bowling.

SAD LAMBASTS CONGRESS FOR JUSTIFYING  1984 SIKH MASSACRE
Newdelhi, November 25 : The Shiromani Akali Dal lambasted the PPCC Spokesman Mr. Sukhpal Singh Khaira for his comments justifying 1984 sikh massacre and described the statement as double standards of the Congress leader.
            Reacting strongly to the statement of Mr. Khaira, the SAD Secretary and Spokesman Dr. Daljit Singh Cheema said that during a workshop of Congress party’s spokespersons in Delhi Mr. Khaira himself had questioned the party high command that how should the spokespersons  justify 1984 massacre before the media ? But it is ironical to see the same PPCC Spokesman now coming with a strange logic to defend the Congress in Delhi state assembly elections.
            Dr. Cheema further said that on one hand the Congress party has given a ticket to the son of Mr. Jagdish Tytler, prime accused in 1984 anti sikh riots, sending the impression that Congress party still stands committed to the second generation of perpetrators of crime against Sikhs and on the other hand the Congress leaders are shredding crocodile tears in the streets of Tilak Nagar of Delhi which has suffered the most during 1984 anti sikh riots.

SAD ALLEGES LARGE SCALE BOGUS VOTES IN RAJOURI GARDEN

The Shiromani Akali Dal urged the Election Commision of India to conduct an enquiry into the registration of bogus votes in 27- Rajouri Garden Assembly Constituency.
In a written complaint filed by the Shiromani Akali Dal Secretary and Spokesman Dr. Daljit Singh Cheema the SAD alleged that 266 bogus votes have been registered in Khayala village which is the native place of official candidate of Indian National Congress Party Mrs. Dhanwanti Chandila. Dr. Cheema alleged that in two small plots bearing house nos WZ 101 and WZ 102, 93 & 142 bogus votes have been registered respectively and 42 votes have been registered in the same houses in the supplementary voter list issued by the returning officer.
Dr. Cheema informed the commission that it is surprising to see that in the same houses five years ago a similar complaint of registration of bogus votes was filled by Shiromani Akali Dal on 25 November, 2008. In that case the house nos were also WZ 101 & WZ 102.
The Shiromani Akali Dal demanded immediate deletion of all bogus votes, strict punishment to the guilty officials and strict action against the Indian National Congress party candidate Mrs Chandila.
