West Bengal Election Watch and Association for Democratic Reforms (ADR) have analysed the self-sworn affidavits of 169 candidates out of 170 candidates who are contesting in Phase 6 of the West Bengal Assembly Elections to be held on 5th, May2016.Please find below a brief summary of the same.

Criminal Background

Candidates with criminal cases: Out of the 169 candidates analysed, 33(20%) candidates have declared criminal cases against themselves.

·         Candidates with serious criminal cases: 27 (16%) candidates have declared serious criminal cases including cases related to murder, attempt to murder, theft, crimes against women etc.
·         Candidates with cases related to Murder: 4 candidates have declared charges related to Murder (Indian Penal Code Section-302).

West Bengal Election Watch (WBEW) and Association for Democratic Reforms (ADR) have analyzed the affidavits of 245 outgoing MLAs who are contesting again in the 2016 West Bengal Assembly Elections.

  • Average Assets in 2011 Elections: The average assets of these 245 re-contesting MLAs fielded by various parties including independents in 2011 were Rs 60.11 lakhs (Rs. 60, 11,270).
  • Average Assets in 2016 Elections: The average assets of these 245 re-contesting MLAs in 2016 is Rs 1.27 crores (Rs. 1, 27, 27,880).
  • Average Asset change from 2011 to 2016: The average assets of these 245 re- contesting MLAs, between the West Bengal Elections of 2011 and 2016increased by Rs. 67.16 lakhs (67, 16,610).

Aanjan, Aadityansh shine in the 2nd round of JK Tyre IndiKarting National Series
·         Goan lads lock out all podiums in key support races
Goa, 2nd May 2016: The JK Tyre IndiKarting National Series brought back Kart racing to Goa after a span of over 5 years as the scenic Goa Karting Circuit played host to the 2nd round of India’s largest Karting Series. The event received an enthusiastic welcome with an impressive 141 entries registered across all categories.
The star of the event was Aanjan Patodia from Pune who notched up 3 victories out of 3 races in the Pro Senior category including the crucial reverse grid start race 2 where he climbed from last on the grid to 1st place. Aaroh Ravindra was a close 2nd place each of the 3 races, but was unable to mount a challenge on Aanjan. Bengaluru’s Rahul Sharan managed 3rd in 2 races while Rishab Rathi came 3rd in 1 race.
The crowd favourite was the Pro Cadet category for the youngest racers in the age group of 7 to 12 years. Aadityansh Kaulshi from Pune set the track alight with back to back victories in the first 2 races. His victory in the reverse grid race came amidst some excellent overtaking manoeuvres. Hoshmand Elavia from Mumbai did well to win race 3 & also bag 2 runner-up trophies. Kogileti Saatvik earned a runner up trophy in Race 1 while Ruhan Alva managed third place on 2 occasions.
The Senior Open & Senior Amateur races saw an all Goan Podium with Akshay Hede, Niazam Ahmed & Tej Naik bagging the top 3 spots. In the Amateur category it was Sufiyan Shaikh, Ameen Shaikh & Digvijit Chavan who locked out the podium. The top 3 from both these categories will win direct invitations to represent Goa, at the National Final in Delhi in June.
The women’s category saw an impressive entry list of 11 participants. Amanda Gomes won ahead of Efigenia, Miranda & Natasha Awhad.
Digvijit Chavan won the corporate category ahead of Donovan Vaz & Taj Naik, while Kevin Barreto won the Master category defeating Niazam Ahmed & Clibe Joshva of Pune. Avdumber Hede participating in his first race in many years won the Senior Plus category ahead of Nickson Shiva & Akash Makwana making it another all Goan Podium. Jonathan Kuriokose won the Pro Junior ahead of Aditya Joshi.
“It was great to see such a fantastic turnout from the Goans. They practically locked out the podiums in all the support categories. 141 entries is good for Goa & thanks to JK Tyre & Tata Motors, we have once again been able to bring motorsport to the masses” said Rayomand Banajee,  Director, RR Motorsports Management Pvt. The JK Tyre IndiKarting National Series powered by Tata Motors was created with the intention of expanding the reach of Motorsport in the country. The FMSCI sanctioned National Series is also the largest Karting series in India & the world’s most affordable series of its kind.
The JK Tyre IndiKarting National Series now moves to Vadodara on 14 & 15 May, before moving on to Ludhiana & then finishing in the National Capital Region in June.

Background:
Information based on studies conducted by CMAI/TEMA pertaining to existing status in India/world, various judgments of Delhi High Court, CCI, papers/notes of CCI/DIPP/Govt. and our recommendations etc. are available at
Of late IPR on electronics, telecom, and mobile has been receiving attention with manufacturers and there are undefined costs on manufacturing.
DIPP came up with open consultations for IPR policies especially with reference to SEP and FRAND. CMAI/TEMA has filed the responses that can be seen athttp://cmai.asia/ipr/download.php. The same would be discussed in the conference and any other suggestions/recommendations sent to Government at higher level. Executive Summary of these recommendations are given hereunder.
The news in Hindustan Times on 23.2.2016 with heading “Make in India runs into high royalty fee hurdle” highlighted the grievances of the manufactures of smart phones/cell phones in India, particularly on the issue of high cost of Royalty payable to the entities having Standard Essential Patents (SEPs). Such high cost has become a hurdle in the Govt. of India’s initiative of “Make –in-India”. It is also a matter of concern that the Royalty is being charged on the value of entire device of mobile phone in place of the value of the component in which such Patents are used.
Delhi High Court in its judgment dated 30.3.2016 has upheld the orders of CCI, directing the DG CCI to investigate the matter regarding violations of the provisions of the Competition Act by Ericssons, as SEP holders. As per Consultation paper floated by DIPP vide para 10.2.1.1
CCI in its preliminary order stated that, in the relevant product market, Ericsson was ‘the largest holder of SEPs for mobile communications like 2G, 3G and 4G patents used for smart phones, tablets etc. and thus was in a dominant position in the market for devices that implement such standards. CCI expressed that ‘FRAND licenses are primarily intended to prevent “patent hold­up” and “royalty stacking” and observed that “patent hold-up” undermines ‘the competitive process of choosing among technologies’ and thus threatens ‘the integrity of Standard Setting activities. CCI also said that Ericsson’s royalty rates were excessive and discriminatory, given that they were set as a percentage of the price of downstream products instead of as a percentage of the price of the GSM or CDMA chip
The CCI concluded that the requested royalties ‘had no linkage to the patented product’ and were thus ‘discriminatory as well as contrary to FRAND terms’. CCI further ordered investigation in the matter by the Director General.
There is issue of SSO forming the standards without informing the details of patents involved and royalties payable on same.
There is also ambiguity on SEP, as the same are not declared by SSO or any other statutory authority. SSO while forming the standards hardly scrutinize or validate the patents and do not prescribe any guidelines for licenses, which are left for private individual negotiations
The patentee undertakes to SSO to grant license on FRAND basis, but there is any acceptable definition of FRAND and it is left to private negotiations. Due to NDA, the patentee or licensees do not inform the existing terms of royalty with other users. Finally the matter lands up in civil courts.
In the courts, majority of disputes are settled by way of out of Court settlements.
High cost of Royalty has always been a cause of concern in the minds of mobile and telecom manufactures and the rate of Royalty has always been the issue contested in the Courts not only in India but also abroad. The law regarding fixation of Royalty is in the developing state. Any determination, though claimed to be on FRAND basis, is hardly a standard industry practice. The determination on so called FRAND basis has always been a question challenged in the Courts along with the issue that whether or not the Royalty should be charged on entire value or to it should be restricted to the small component in which the SEPs has been utilized.
CMAI is working closely for bringing in harmony between Industries and Government.
