NEW DELHI: Janata Party chief Subramanian Swamy said will seek the prime minister's sanction to prosecute Chidambaram and he was moving an application in the Special Court seeking home minister P Chidambaram's questioning by CBI and including his name in the charge-sheet as an additional accused in the 2G Spectrum allocation scam. He had earlier narrated a cabinet committee had directed former communications minister A. Raja and the then finance minister, Chidambaram, to arrive at the price at which the 2G radio waves were to be sold.The then home minister, Shivraj Patil, had prepared a report against allocating spectrum to Swan Telecom and Unitech on security reasons, he added.He said Chidambaram was informed by the then home minister Sivaraj Patil that Etisalat and Telenor, two foreign telecom players, should not be allowed to operate in India. “Etisalat had links with the Pakistani spy agency ISI and Dawood Ibrahim while Telenor had Chinese links. Chidambaram did not tell Raja about this information. Later also when he took over as the home minister, he kept the information to himself,” Swamy said.
"A Raja (former telecom minister) now has been charge-sheeted and one of the charges being that he deliberately fixed the low price for spectrum and thus causing a huge revenue loss for the nation. In view of the fact that the documents and evidence clearly established that P Chidambaram jointly decided to fix this low price, hence if Raja is culpable so is Chidambaram and the CBI therefore is guilty of a lapse in not including Chidambaram along with Raja (in charge sheet)", alleged Swamy in a statement.
Janata Party president explained that there isn't any need for sanction to prosecute home minister Chidambaram as the matter pertained to the period when the latter was the finance minister. Referring to a constitutional bench judgment of the Supreme Court, he said: "Once there is a change in the portfolio, sanction for offenses committed in this case as minister of finance will not require sanction for prosecution."
