ILLEGAL, FRAUDULENT, DECEPTIVE ACQUISITION OF RATNA CEMENTS (YADWAD) Ltd., BY THE CHILDREN OF THE CHIEF MINISTER SRI.B.S.YEDDIYURAPPA AND CAUSING LOSS TO STATE GOVERNMENT UNDER TAKINGS AND PREFERENTIAL ALLOTMENT OF LIMESTONE MINING LEASE OF 1417.5 Acres of IN YADWAD VILLAGE, BELGAUM DISTRICT, KARNATAKA.
When the JDS and BJP Government came in to power in the state of Karnataka in Feb.2006 the Deputy Chief Minister of BJP Sri.B.S.Yeddiyurappa was Finance Minister and Sri.Katta Subramanya Naidu was Industry Minister in the Government Headed by Sri.H.D.Kumarswamy.
Sri.B.S.Yeddiyurappa and Sri.Katta Subramanya Naidu entered in to sinister conspiracy in acquisition of Cement Company namely Ratna Cements (Yadwad) Ltd., Sri.B.S.Yeddiyurappa being the finance minister had director control over the state government undertaking namely Karnataka State Industrial Investment Development Corporation, which came under the finance department and Sri.Katta Subramanya Naidu the industry minister had control over industries and commerce department GoK which had control over the company M/s Ratna Cements (Yadwad) Ltd., Belgaum on policy decision and allotment of mining quarry.
The conspiracy to defraud the state Government undertaking namely Karnataka State Industrial Investment Development Corporation begin in 2006 as soon as came to power and was completed during 2009. The modus operandi being as follows:-
- 2 -
M/s. Ratna Cements (Yadwad) Ltd was incorporated 25.04.1979 with registered office at Yadwad, Gokak Taluk, Belgaum District, for setting up of a 450 MPTD cement plant. During the year 1996 the company had obtained Term Loan Rs.4 Crores from KSIIDC, repayable in 20 quarterly installment with a moratorium of 24 months, the company Ratna Cements could not repay the principle and interest in accordance with Term Loan schedule and during 2006 when Sri.B.S. Yeddiyurappa became the Deputy Chief Minister, one time settlement proposal was initiated with KSIIDC, with sole intension to acquire the company later on, it was stated the promoters and company net worth had been completely eroded and settlement of Rs.4.8 Crores was made to be accepted by KSIIDC by the Deputy Chief Minister Finance Sri.B.S.Yeddiyurappa by waving Rs.7.5 Crores (appx) of interest un serviced to KSIIDC and also KSIIDC had made investment in form of shares subscription for 2.9 Lakhs shares at the rate of Rs.10/- each of Ratna Cements (Yadwad) Ltd, which it continues to hold till date in the form of investment even though substantial loan amount had been sacrificed by KSIIDC and had lost huge amount in form of waiver of interest for the Term Loan it had advanced, which is very strange.
The settlement to KSIIDC had been done by Sri.Vandevalli Suriraj son in law of Industry minister Sri.Kattasubramanya Naidu. Subsequently after settlement of the dues of KSIIDC the children of Sri.B.S.Yeddiyurappa the current Chief Minister of Karnataka acquired a non banking financial company registered in West Bengal having its registered office at No.29/A, Meston Street, 3rd Floor, Room C-2, P.S.Bowbazar, Culkatta, West Bengal namely Indivar Kutir (P) Ltd., on 30.09.2009 the details of the company as per ROC records are as follows:-

The intention for acquiring Pvt Ltd company incorporated in other state, which had acquired company in Karnataka is to ensure that the general public and the Government officials do not know the real owners of the company i.e. Ratna Cements (Yadwad) Ltd., who are taking preferential favours in the form of waiver of loan and allotment of mining lease from the Government departments of state of Karnataka.
The company financial statements as at 31.03.2009 reflects share capital including reserves and surplus at Rs.596.81 Lakhs it had a carry forward book loss of Rs.4 Lakhs and had assets in the form of Loans and advances of Rs.608.54 Lakhs. However the paid up shares of the company of 716700 of Rs.10/- each has been transferred at par to Bhagat Homes Pvt Ltd., and others for Rs.71,67,000/-. Thus the company worth Rs.596.81 Lakhs has been acquired for Rs.71.67 Lakhs which is nothing but a sham transaction.
Subsequently this company Indivar Kutir Pvt Ltd acquired the shares of Ratna Cements (Yadwad) Ltd on 30.09.2009 of 32,44,300 shares of Rs.10/- each valued at Rs.3,24,43,000/- thus completing the acquisition of Ratna cements (Yadwad) Ltd.,

On perusal of the financial statements of Ratna Cements (Yadwad) Ltd, we find new promoters i.e. Dr.Suriraj Vandavalli and Bhagat Homes Pvt Ltd and Indivar Kutir (P) Ltd have brought in share application money to the tune of
- 6 -
Rs. 8.46 Crores, Rs.4.09 Crores and Rs.3.83 Crores for the financial year 2007-08, 2008-09 and 2009-10 totaling in all Rs.16.38 Crores and also they have put in during the same period Rs.68 Crores in the form of un secured loan to company Ratna Cements (yadwad) Ltd totaling in all Rs.85 Crores, which is reflected in the financial statement for the year ending 31.03.2010.
Thus the company Ratna Cements (Yadwad) Ltd., was illegally, fraudulently and deceptively taken over by the Chief Minister children by defrauding the state Government under taking KSIIDC. Subsequently the company entered in to one more adventure in the form of illegally acquiring mining lease for limestone in an area of 1417.5 Acres in Yadwad Village, Gokak Taluk, Belgaum District during the regime of Chief Minister B.S.Yeddiyurappa as follows;-
One S.N.Singit s/o Narayana Singit had obtained mining lease No.1828, sanctioned on 1.7.1982 for an extent of 2167 Acres of mine area in Yadwad Village, Gokak Taluk Belgaum District, for raising lime stone, the basic raw material for Cement Industries. The lease was for a period of 20 years. Ratna Cements (Yadwad) Ltd., incorporated on 5.4.1979 was taken over during 1996 by S.N.Kilaru and his son K Gopi Prasad, close associates of Andhra based BJP Leader indirectly getting political patronage from Karnataka, being repeatedly elected to Rajyasabha.
S.N.Singit has filed application for renewal of mining lease to Director Mines and Geology, Mines and geology, on 12.7.2001. In the application it is mentioned that the applicant is an Individual along with the application S.N.Singit failed to enclose the sketch of (map) the mining area to be
- 7 -
renewed. Hence the department issued a notice on 26.6.2002 to furnish maps. S.N.Singit did not care to submit the requisite maps. An endorsement was issued on 27.2.2007 by DMG stating that the application for renewal cannot be considered as he has failed to submit the required documents.
Immediately thereafter Ratna Cements (Yadwad) Ltd has given undertaking letter dated 13.4.2007 to the DMG, that they will be paying the arrears if any held in the name of the company even though the mining lease was not in the name of Ratna Cements (Yadwad) Ltd and further Ratna Cements (Yadwad) Ltd has made an application for renewal of mining lease to DMG on 12.4.2007 enclosing copy of the sketch, covering mining area of 1417.5 Acres, income tax clearance certificate even though Ratna Cements (Yadwad) Ltd was not the original mining lease holder.
At this stage the Depart of Mines & Geology started taking action in gross violation of the mining rules under MCR 1960 at the instance of Sri.B.S.Yeddiyurappa the then Deputy Chief Minister, whose family members had interest in acquiring both Ratna Cements (Yadwad) Ltd and the vast limestome mine area.
The Assistant Commissioner, Bylahongala Sub Division in his letter dated 12.5.2008 to the Deputy Commissioner, has narrated that Ratna Cements (Yadwad) Ltd had dues of Rs.1.85 Crores to the commercial tax department as on 08.9.2004 and thereafter they have paid only 16.53 Lakhs as on 14.8.2007 and an amount of Rs.1.68 Crores has been illegally exempted during 2007 and that renewal of mining lease is not appropriate. The point that should be noted is that B.S.Yeddiyurappa was the Finance Minister, when this exemption has taken place.
- 8 -
Ratna Cements (Yadwad) Ltd, have paid on 2.7.2007 Rs.91.54 Lakhs the dues to the mines and geology department towards the mining lease No.1828 held by S.N.Singit even though Ratna Cements (Yadwad) Ltd was not the lease holder of mine and this has been done at the instance of Sri.B.S.Yeddeiyurappa when he was Deputy Chief Minister and Sri.Katta Subramanya Naidu.
The Director, Mines & Geology, in his letter dated 16.10.2009 to the Secretary to Government, Mines Department, has reported that the Lessee has filed application on 12.7.2001 for renewal of mining lease belatedly by 12 days and has recommended to condone the delay suppressing the fact of issual of endorsement rejecting the application on 27.2.2007. thereafter at the behest of B.S.Y. as his children had taken over control of Ratna Cements (Yadwad) Ltd through their children promoted company namely Indivar Kutir Pvt Ltd., to the secretary to Government to condone delay vide GO No.355/MMN/2009 dated 4.11.2009 even though Ratna Cements (Yadwad) Ltd is not the original lease holder of the mine area. Further Director, Mines and Geology department has illegally permitted to carryout mining by allowing working permission for a period of 6 months vide letter dated 19.11.2009 to Ratna Cements (Yadwad) Ltd, even in the absence of permission from the Ministry of Environment Clearance and Forest, Government of India and without fixing of 1417.5 Acres of area by joint measurement of various authorities, which in fact was held on 18.2.2010.
BSY has misused his office right from April 2007 to fraudulently obtained about 1417.5 Acres of prime limestome area, at Yadwad Village, Gokak Taluk, Belgaum Distric, to confer favour to his children held company namely Ratna Cements (Yadwad) Ltd.
- 9 -
The following documents are enclosed to justify illegality and the favours done to Ratna Cements (Yadwad) Ltd.,
1. Financial statement of Indivar Kutir P Ltd., and Share holding pattern.
2. financial statement of Ratna Cements (Yadwad) Ltd and share holding pattern, including copy of annual return for share transfer to Indivar Kutir Pvt Ltd,

Selection & removal the Lokpal Member - Contentious:Prashant Bhusan
The government indicated that there is a broad consensus on major issues of the Lok Pal Bill after discussions with civil society members today in New Delhi. Briefing the media after the 8th meeting of the Joint Drafting Committee on Lokpal, HRD Minister Kapil Sibal said there is agreement on about 85 per cent clauses of the bill. Describing today's meeting as a major step forward, the Minister said areas of divergence and differences will be discussed in the all party meeting to be convened by the Prime Minister next month. Mr. Sibal reiterated the government's commitment to introduce a strong Lok Pal Bill in the monsoon session of Parliament.
Briefing the media, noted lawyer Prashant Bhusan said, in tomorrow's meeting, the Civil Society and the Government Representatives will exchange their drafts to hammer out consensus on agreed issues. He said differences on major issues will be presented as two alternatives in a single draft to be taken up by the government at appropriate fora. In reply to a question, Mr Bhusan said, two new areas of disagreement, selection and removal process of the Lokpal, appeared in today's meeting.
Both the government side and the Anna Hazare team said the three-hour-long meeting was held in a "very cordial atmosphere" but differed on the extent of its success.
The committee will meet on Tuesday for the last time during which both the sides will exchange their drafts on which they will comment upon.HRD Minister Kapil Sibal told reporters that 80 to 85 percent issues were resolved while activists Arvind Kejriwal and Prashant Bhushan differed on this percentage but contended that there was consensus on majority of the issues."On a range of issues, there is a broad agreement. It is a major step forward. Both sides feel we should move towards a consensus to formulate a draft where difficult issues of divergence are spelt out when it goes to political parties sometime in July," Sibal said on Monday.
On the basis of this, a strong Lokpal Bill can be drafted and sent to Cabinet so that it can be introduced in Parliament in the Monsoon session.
"There is agreement on 80 to 85 per cent of issues...I feel this is a very major breakthrough," Sibal said.
Hazare also said the meeting was good but left it to Bhushan and other associates to give details.
Explaining on the new issues that came up, Bhushan said, "according to government version, the appointment committee is filled with politicians and government officials. Our bill has provision for an independent, broad-based committee like the Chief Election Commissioner."
The government version proposes that the selection committee should comprise Prime Minister, Speaker, Leaders of both Houses of Parliament, Leaders of Opposition of both Houses, Lok Sabha Speaker, Home Minister, Cabinet Secretary, a Supreme Court judge and a High Court Chief Justice, Kejriwal said.
"In their committee, there are more politicians," he said and questioned this move, contending that the appointment of Lokpal will be then under their direct control although they would be ones against whom the ombudsman would be conducting investigations at some stage.
On the removal procedure of Lokpal, Bhushan said the government position was that only it can approach the Supreme Court in this regard while the civil society insisted that "anyone" could move the apex court for the purpose.
"The issue of bringing the post of Prime Minister under purview of Lokpal was not discussed today," he said about the meeting which was not attended by Justice Santosh Hegde, one of the five members of the civil society.
He will attend Tuesday’s meeting.

Lokpal joint drafting committee the eighth meet today
Nksagar-Sagar Media Inc: 20 June 2011 New Delhi:
The representatives of government and civil society, the two sides will meet on Monday its a Lokpal joint drafting committee the eighth meet in a last ditch attempt to resolve contentious issues and hammer out a consensus on the Lokpal Bill.On the eve of the meeting of the Lokpal joint drafting committee - the eighth since April 16, Senior ministers held discussions for nearly three hours on Sunday evening to finetune the Government's strategy. The deliberations, chaired by Finance Minister and panel chairman Pranab Mukherjee, were attended by Union ministers Kapil Sibal, Salman Khurshid and Veerappa Moily - all members of the committee.
Minister of State in PMO V Narayanaswamy also took part in the parleys. However, another member of the committee Home Minister P Chidambaram was not present as he was out of town.None of the ministers spoke to media after the meeting which lasted two hours and 45 minutes.Monday's deliberations could be the last meeting of the joint committee and another round will be held on Tuesday if the discussions for an anti-corruption watchdog are not concluded on Monday.
Karnataka Lokayukta Santosh Hegde, a member of the drafting committee, denied any split in the Anna Hazare camp and said he will attend the panel's meeting and backed the social activist's planned fast from August 16 after opposing it.
After his comments on Hazare's fast and inability to take part in the meeting in Delhi fuelled speculation of differences among civil society representatives, Hegde said he will be present on June 21 to show there is 'no rift'.
While the government has virtually ruled out bringing the post of the Prime Minister under the ambit of the anti-corruption watchdog, Congress core group has favoured convening an all-party meeting on the issue of inclusion of the PM. The Hazare camp is pressing for bringing the Prime Minister under Lokpal's purview.
HRD Minister Kapil Sibal, a member of the Joint Drafting Committee, said the view within the government is that Prime Minister should not be included within the ambit of Lokpal. He, however, said once the PM demits office, he should not be "exonerated" from prosecution.
Santosh Hegde however feels keeping the Prime Minister out of Lokpal till he demits office will not serve the purpose of having an effective investigation because there will not be any trail of any misconduct.A final view on the ticklish issue will be taken by the union cabinet once the draft bill reaches it after consultation with political parties, he said.
A government representative of the Committee said the inclusion of judiciary and conduct of MPs inside Parliament in the proposed legislation was "not possible" as it would amount to amending the Constitution."The Committee's mandate is clear and that is to enact a legislation. The members led by Anna Hazare are also clear about the mandate...it is in the notification," he said. But the member insisted that the government side will try its best to convince the civil society members about its "stand and compulsions".
However, the Anna Hazare team dubbed the argument to keep the Prime Minister out of Lokpal's ambit as "absurd"."There is no reason whatsoever to exclude the Prime Minister. Whatever arguments are being given seem to suggest that if the Prime Minister was subject to anti-corruption investigation then he would become dysfunctional," lawyer Prashant Bhushan, a team member, said.
He said the argument was "absurd" as the Prime Minister can be investigated by the CBI, which is under his control, but not an independent agency like Lokpal. If the two sides fail to settle their differences, a draft bill with points of agreements and disagreements will be prepared. The government and civil society are at loggerheads on the issues of inclusion of prime minister, judiciary and conduct of MPs inside Parliament.

Nigamanand case: Fresh viscera test ordered
On allegations that Swami Nigamanand was poisoned, authorities on Thursday ordered a second viscera test of the seer who died after a four-month fast against quarrying in Ganga river bed.Haridwar District Magistrate Meenakshi Sundaram has decided that another sample of viscera of Nigamanand be taken after the founder head of Matri Sadan ashram and his guru, Shivanand, gave a written request in this regard, said Senior Superintendent of Police (SSP) Kewal Khurana, a day after the Uttarakhand Government recommended a CBI probe into the circumstances of his death.
A panel of doctors will take the sample at Matri Sadan ashram, where the body of the 36-year-old seer has been kept. The DM also made it clear that it is not a second post mortem and that only viscera samples will suffice, officials said on Thursday.Uttarakhand Minister Madan Kaushik had on Wednesday said that the government is ready for a fresh viscera test if the ashram and his family members are not satisfied.
Though the post mortem report of Nigamanand had stated coma, septicaemia and degenerative brain disorder as the cause of death, Shivanand had alleged that Nigamanand died of poisoning after he was administered a lethal injection at the behest of quarrying mafia. The death of Nigamanand on 13th June has sparked intense criticism of the BJP government with opposition Congress on Thursday demanding resignation of Chief Minister Ramesh Pokhriyal Nishank alleging that the seer could not be saved due to negligence of the state government.
"The death of Nigamanand due to lack of proper medical care clearly shows that the BJP government has completely failed to discharge its duty," spokesman of Uttarakhand Congress Legislature Party Kishore Upadhyay said on Thursday.
"Chief Minister Ramesh Pokhriyal Nishank should immediately resign from the post," he said.
Meanwhile, a tussle broke out between the ashram and seer's family members over taking possession of the seer's body.
The family threatened to go on an indefinite fast if the body is not handed over to them for the last rites.
Nigamanand's father Subhash Chandra Jha and other family members, who reached the ashram at Haridwar, said they wanted to perform his last rites at his native place in Darbhanga district of Bihar, Superintendent of Police (City) K L Shah said.
However, their request has been turned down by the sadhus of the ashram who said that Swami was a sadhu and so he will be given 'Bhu samadhi' in the ashram itself, Shah said.
The administration is taking legal opinion on the issue following which a decision in this regard would be taken, Shah said.
Meanwhile, Nigamanand's family has threatened to sit on an indefinite fast outside the ashram if the body was not handed over to him.
Nigamanand's elder brother Satyam Kumar Ashish alleged that the seer had told him there was pressure on him from his guru to undertake a fast and continue it even when he was not in the condition to do so.
"Nobody is helping us.... we were allowed to see the body for not more that 10 minutes. We are helpless. We will go on a hunger strike and die, that's all," he said. The Congress alleged that proper medical care was not provided to Nigamanand as the state government is under pressure from quarrying mafia.Upadhyaya claimed that he and Union Minister of State for Agriculture Harish Rawat wrote a letter to Chief Minister that Nigamanand should be shifted to AIIMS in New Delhi but no attention was given to their concerns.

India witness century unique lunar eclipse
Nksagar-Sagar Media Inc: New Delhi:
Moon's bright white glow turned crimson brick red when it delved into the dark centre of the Earth's shadow during the century's longest and darkest lunar eclipse.
The awesome spectacle of the moon being eclipsed was visible all over the country, including the national capital. The full moon appeared much dimmer than usual, but sunlight passing through the Earth's atmosphere gave the lunar surface a deep reddish hue.
This was the century's longest and darkest total lunar eclipse as the Moon immersed deeply inside the umbral (darker) shadow of the Earth, Nehru Planetarium Director N Rathnasree said. The total phase of the eclipse lasted 100 minutes. The last eclipse to exceed this duration was in July 2000.
The next such eclipse will only take place in 2141.
The penumbral lunar eclipse began at 22:54:34 IST and will end at 04:30:45 IST, she said. The total lunar eclipse began at 00:52:30 IST and ended at 02:32:42 IST. While the partial eclipse began at 23:52:56 IST and ended at 03:32:15 IST.
As the earth came in between the sun and the moon, its shadow first began sweeping across the moon blocking out much of its bright light and as the shadow descended gently, the moon's face turned red.A lunar eclipse occurs when the Earth in course of its orbit around the Sun, comes between the Moon and Sun in such a way that Moon is hidden in the shadow cast by Earth. This can occur only when the Sun, Earth, and Moon are aligned in a straight line, C B Devgun from Science Popularisation Association of Communicators and Educators (SPACE) said.

We were in touch with him over phone. We waited till 5 pm. When he did not give statement we decided to go to press. We told him that," Sibal explained, referring to making public the letter written by one of his close associate. "If he backs out, how will we trust him," the Minister questioned.Congress leader Digvijay Singh justified the action against Baba Ram Dev. Mr. Singh accused him of inciting people despite striking a deal with the government for ending his protest. Mr. Singh also demanded an inquiry into the thousands of crores of rupees of property owned by Ram Dev. Senior party leaders held a high level meeting sunday evening at the residence of party president Mrs. Sonia Gandhi.Briefing reporters after the meeting, party spokesperson, Mr. Janardan Dwivedi said in New Delhi that the party discussed the current situation and decided to direct all the party workers to make people aware about the works done by central and party led state governments for people's benefit, so that the strategy of opposition parties could be foiled.

Section 144 of CRPC in New Delhi district:
In an effort to pre-empt any protest by supporters of Baba Ramdev, Delhi Police on Sunday imposed prohibitory orders in New Delhi district where such agitations were apprehended."We have imposed section 144 of CRPC in New Delhi district," a senior police official said. The decision to impose prohibitory orders came in the backdrop of some followers of Ramdev camping at Jantar Mantar after they were ousted from the Ramlila Maidan where their congregation was disrupted by a mid-night police action. The official said police anticipated protest at India Gate, Boat Club or Jantar Mantar, places which fall in New Delhi district. With talks breaking down, police swooped down on Baba Ramdev a little past midnight and detained him after firing tear gas shells and resorting to lathicharge on his supporters. The dramatic police action came after government and the 46-year-old Yoga Guru had accused each other the previous night of betrayal on mutual assurances.

#PTI: Supreme Court issues notice to Govt on forceful eviction of Ramdev
Supreme Court issues notice to Centre on the forceful eviction of yoga guru Ramdev and his followers from Ramlila Maidan.Indian Politics on black money : Ramdev issue (PTI) Undeterred by his forceful eviction from New Delhi, Baba Ramdev resumed his agitation at his ashram here, saying the 'satyagraha' will continue till his demands on curbing corruption and black money are met by the Centre.
Baba Ramdev sat on 'satygraha' along with his supporters and disciples at 'yagyashala' of his Patanjali Yogpeeth late last night, yogpeeth sources said today. The yoga guru, who was bundled out of the national capital after police crackdown on his followers, tried to resume his satyagrah in Noida yesterday but was not allowed to enter Uttar Pradesh. He was stopped on the
border of Muzaffarnagar district at Bhuraheri police check post where the administrative officials asked him to return to Uttarakhand.Later, Baba returned to Patanjali Yogpeeth last night and began his fast.
Government spokesperson on Sunday justified police action to end Ramdev's agitation saying the Yoga Guru had violated the undertaking for permission and had even backed out on his assurances.Union Minister Kapil Sibal, explained that there were apprehensions about law and order situation in Delhi as Ramdev had collected 50,000 people for "political aasan" (manoeuver) although he had sought permission for a yoga camp for a gathering of 5,000 only. "It was not a Yoga platform, but a political platform. The law and order had to be enforced in Delhi. We did not want any disruptions in that," he told reporters. To a question, he said the party and the government were united on the police action."Absolutely 100 per cent. No such action takes place without 100 per cent unity in the government and the party," the minister said.He rejected BJP's allegations that the crackdown was reminiscent of Emergency. Sibal alleged that Ramdev was in league with the RSS as he referred to the presence of Sadvi Ritambhara in his protest. Speaking in the same vein Union Minister Subodh Kant Sahay said that discussions were being held with Ram Dev for more than 20 days and the government's intentions were clear on tackling the issue of corruption and black money. The Union Minister Kail Sibal said Ramdev was not a trustworthy person as he had "cheated" the government and also his followers."He reached an agreement with the government but did not tell it to his followers," Sibal said.He said government and Ramdev had reached an understanding as per which the Yoga Guru was supposed to announce calling off his strike by Saturday afternoon, but he did not honour the commitment."Despite assurances he did not make the announcement.
