Lokpal joint drafting committee the eighth meet today

Nksagar-Sagar Media Inc: 20 June 2011 New Delhi:
The representatives of government and civil society, the two sides will meet on Monday its a Lokpal joint drafting committee the eighth meet in a last ditch attempt to resolve contentious issues and hammer out a consensus on the Lokpal Bill.On the eve of the meeting of the Lokpal joint drafting committee - the eighth since April 16, Senior ministers held discussions for nearly three hours on Sunday evening to finetune the Government's strategy. The deliberations, chaired by Finance Minister and panel chairman Pranab Mukherjee, were attended by Union ministers Kapil Sibal, Salman Khurshid and Veerappa Moily - all members of the committee.

Minister of State in PMO V Narayanaswamy also took part in the parleys. However, another member of the committee Home Minister P Chidambaram was not present as he was out of town.None of the ministers spoke to media after the meeting which lasted two hours and 45 minutes.Monday's deliberations could be the last meeting of the joint committee and another round will be held on Tuesday if the discussions for an anti-corruption watchdog are not concluded on Monday.

Karnataka Lokayukta Santosh Hegde, a member of the drafting committee, denied any split in the Anna Hazare camp and said he will attend the panel's meeting and backed the social activist's planned fast from August 16 after opposing it.

After his comments on Hazare's fast and inability to take part in the meeting in Delhi fuelled speculation of differences among civil society representatives, Hegde said he will be present on June 21 to show there is 'no rift'.

While the government has virtually ruled out bringing the post of the Prime Minister under the ambit of the anti-corruption watchdog, Congress core group has favoured convening an all-party meeting on the issue of inclusion of the PM. The Hazare camp is pressing for bringing the Prime Minister under Lokpal's purview.

HRD Minister Kapil Sibal, a member of the Joint Drafting Committee, said the view within the government is that Prime Minister should not be included within the ambit of Lokpal. He, however, said once the PM demits office, he should not be "exonerated" from prosecution.

Santosh Hegde however feels keeping the Prime Minister out of Lokpal till he demits office will not serve the purpose of having an effective investigation because there will not be any trail of any misconduct.A final view on the ticklish issue will be taken by the union cabinet once the draft bill reaches it after consultation with political parties, he said.

A government representative of the Committee said the inclusion of judiciary and conduct of MPs inside Parliament in the proposed legislation was "not possible" as it would amount to amending the Constitution."The Committee's mandate is clear and that is to enact a legislation. The members led by Anna Hazare are also clear about the mandate...it is in the notification," he said. But the member insisted that the government side will try its best to convince the civil society members about its "stand and compulsions".

However, the Anna Hazare team dubbed the argument to keep the Prime Minister out of Lokpal's ambit as "absurd"."There is no reason whatsoever to exclude the Prime Minister. Whatever arguments are being given seem to suggest that if the Prime Minister was subject to anti-corruption investigation then he would become dysfunctional," lawyer Prashant Bhushan, a team member, said.

He said the argument was "absurd" as the Prime Minister can be investigated by the CBI, which is under his control, but not an independent agency like Lokpal. If the two sides fail to settle their differences, a draft bill with points of agreements and disagreements will be prepared. The government and civil society are at loggerheads on the issues of inclusion of prime minister, judiciary and conduct of MPs inside Parliament.

I managed to sort out my game on the third day at the driving range after taking some advices from my mental conditioning coach. I started my day very well today and when I hit a driver on left rough on the hole no. 17th, I was sure that the title is in my hands.”

Nigamanand case: Fresh viscera test ordered

On allegations that Swami Nigamanand was poisoned, authorities on Thursday ordered a second viscera test of the seer who died after a four-month fast against quarrying in Ganga river bed.Haridwar District Magistrate Meenakshi Sundaram has decided that another sample of viscera of Nigamanand be taken after the founder head of Matri Sadan ashram and his guru, Shivanand, gave a written request in this regard, said Senior Superintendent of Police (SSP) Kewal Khurana, a day after the Uttarakhand Government recommended a CBI probe into the circumstances of his death.

A panel of doctors will take the sample at Matri Sadan ashram, where the body of the 36-year-old seer has been kept. The DM also made it clear that it is not a second post mortem and that only viscera samples will suffice, officials said on Thursday.Uttarakhand Minister Madan Kaushik had on Wednesday said that the government is ready for a fresh viscera test if the ashram and his family members are not satisfied.

Though the post mortem report of Nigamanand had stated coma, septicaemia and degenerative brain disorder as the cause of death, Shivanand had alleged that Nigamanand died of poisoning after he was administered a lethal injection at the behest of quarrying mafia. The death of Nigamanand on 13th June has sparked intense criticism of the BJP government with opposition Congress on Thursday demanding resignation of Chief Minister Ramesh Pokhriyal Nishank alleging that the seer could not be saved due to negligence of the state government.

"The death of Nigamanand due to lack of proper medical care clearly shows that the BJP government has completely failed to discharge its duty," spokesman of Uttarakhand Congress Legislature Party Kishore Upadhyay said on Thursday.

"Chief Minister Ramesh Pokhriyal Nishank should immediately resign from the post," he said.

Meanwhile, a tussle broke out between the ashram and seer's family members over taking possession of the seer's body.

The family threatened to go on an indefinite fast if the body is not handed over to them for the last rites.

Nigamanand's father Subhash Chandra Jha and other family members, who reached the ashram at Haridwar, said they wanted to perform his last rites at his native place in Darbhanga district of Bihar, Superintendent of Police (City) K L Shah said.

However, their request has been turned down by the sadhus of the ashram who said that Swami was a sadhu and so he will be given 'Bhu samadhi' in the ashram itself, Shah said.

The administration is taking legal opinion on the issue following which a decision in this regard would be taken, Shah said.

Meanwhile, Nigamanand's family has threatened to sit on an indefinite fast outside the ashram if the body was not handed over to him.

Nigamanand's elder brother Satyam Kumar Ashish alleged that the seer had told him there was pressure on him from his guru to undertake a fast and continue it even when he was not in the condition to do so.

"Nobody is helping us.... we were allowed to see the body for not more that 10 minutes. We are helpless. We will go on a hunger strike and die, that's all," he said. The Congress alleged that proper medical care was not provided to Nigamanand as the state government is under pressure from quarrying mafia.Upadhyaya claimed that he and Union Minister of State for Agriculture Harish Rawat wrote a letter to Chief Minister that Nigamanand should be shifted to AIIMS in New Delhi but no attention was given to their concerns.

Father claim Nigamanand's dead body turn down

(PTI) The family of Swami Nigamanand today threatened to go on an indefinite fast if the seer's body is not handed over to them for the last rites.Swami Nigamanand's father Subhash Chandra Jha and other family members reached the ashram at Haridwar and claimed over his body saying they wanted to perform his last rites at his native place in Darbhanga district of Bihar, Superintendent of Police (City) K L Shah said.

India witness century unique lunar eclipse

Nksagar-Sagar Media Inc: New Delhi:
Moon's bright white glow turned crimson brick red when it delved into the dark centre of the Earth's shadow during the century's longest and darkest lunar eclipse.
The awesome spectacle of the moon being eclipsed was visible all over the country, including the national capital. The full moon appeared much dimmer than usual, but sunlight passing through the Earth's atmosphere gave the lunar surface a deep reddish hue.

This was the century's longest and darkest total lunar eclipse as the Moon immersed deeply inside the umbral (darker) shadow of the Earth, Nehru Planetarium Director N Rathnasree said. The total phase of the eclipse lasted 100 minutes. The last eclipse to exceed this duration was in July 2000.

The next such eclipse will only take place in 2141.
The penumbral lunar eclipse began at 22:54:34 IST and will end at 04:30:45 IST, she said. The total lunar eclipse began at 00:52:30 IST and ended at 02:32:42 IST. While the partial eclipse began at 23:52:56 IST and ended at 03:32:15 IST.

As the earth came in between the sun and the moon, its shadow first began sweeping across the moon blocking out much of its bright light and as the shadow descended gently, the moon's face turned red.A lunar eclipse occurs when the Earth in course of its orbit around the Sun, comes between the Moon and Sun in such a way that Moon is hidden in the shadow cast by Earth. This can occur only when the Sun, Earth, and Moon are aligned in a straight line, C B Devgun from Science Popularisation Association of Communicators and Educators (SPACE) said.

Accusing Congress-led Central government of demitting accountability, BJP today demanded apology from UPA chairperson Sonia Gandhi and Prime minister Manmohan Singh for the police action against Ramdev and his supporters at Delhi's Ram Lila ground on Saturday."Sonia Gandhi and Manmohan Singh owe an apology and explanation to the nation for the naked attempt to deny the basic and fundamental rights guaranteed by the Constitution of India,"BJP general secretary Vijay Goyel said during a press conference here.Public Accounts Committee in its draft report in April this year had questioned the role of the finance ministry, including then finance minister P Chidambaram, in the 2G spectrum scam."The former owner of Aircel has told CBI that Maran, who was earlier the telecome minister, had threatened to eliminate him. But Maran is still continuing as minister," Pradhan said.PTI reports

Law enacted sometime bring glory to the government and many times the undercurrent power to topple the government and many experts call this fall by various other terms. Parliament is final authority in making laws is true but the political experts say to understand the law drafted without inputs of civil society cannot be bill fit for Law and the law enacted and Law practiced are two different aspects and with change of time Law has its own intrinsic vale or currency and in case moods of the people gets rage on the draft of bill move to form the Law may bring change of government. Media reports that Facing Anna Hazare's threat to go on an indefinite fast from August 16, Government and the Congress today hardened its stand, making it clear to activists involved in the drafting the Lokpal Bill that Parliament is the final authority in making laws."I do not believe that four or five persons or a single NGO can claim to be better informed and be the sole repository of all knowledge," Information and Broadcasting Minister Ambika Soni told reporters here.

Congress spokesperson Jayanthi Natarajan also spoke in a similar vein."While the process of consultation is already on, I want to point out that suggestions arising out of this agitation finally will have to go to Cabinet and Parliament", Natarajan said when asked about Hazare's threat. She said, "Law can be made by legislature is the view of every political party

Civil society members can only give suggestions: Cong

Just ponder and feel that civil society members first choice women reservation bill has not seen the light.Land acquisition Act keeps the farmers in tenterhooks, corruptions laws fail to deliver, delivery mechanism of the government unable to bring desired results, nexus of various group gather easy money from the system and away from the system in their own convenience state.Corruption is not raised for the first time but has been the issue since 1975 by JP and 1985 Chandrasekhar- Janata Dal and by Congress in 2003-2004 but robust growth of corrupt people and officials give golden-shake hand. On a day when Anna Hazare sat on a fast protesting the crackdown on Ramdev's protest, Congress virtually declared redundancy of the Joint Committee to draft a strong Lokpal bill.Civil society members can only give suggestions: Congress is repeated many a times then the civil society members for definitely clash on their basic points and will raise hue and cry for not abiding to basics.

Party spokesperson Jayanti Natarajan on Wednesday said civil society representatives "could not be the alternate sources" for lawmaking including the key legislation.Political thinkers in their opinions say,But in democracy each civil society members has the rights to give his/her inputs as the government is always short of ground reality and holistic experiences.
Arun Jaitley thus has said in meeting at constitutions club that Congress leaders thinks to know much and behave in arrogance and is not in mood to listen even when they are in minority as the bill cannot be passed in Upper house if the opposition parties are not taken into confidence for their minority numerical.

Jayanti said further, "There is a constitutional scheme of things needed to be adhered to including taking the views of the Parliament while deciding on the legislation. Whatever they say could be suggestions for draft but it can't be the legislation. This is not a banana republic. We are working under the constitution of India," she said in New Delhi on Wednesday.Experts say to prove watchdog by civil society does not dilute the Constitution but strengthen. In the name of constitution adherence, government is unable to put off the corruption, unable to give accountability for public treasury money allocated, funds sent is not spent in proper way and bills pile up in lines for public welfare.

The Congress spokesperson side-stepped questions whether the Prime Minister should be under the proposed Lokpal bill, noting that the Constitution review committee under Justice M M Venkatachaliah had expressed itself against it.The remarks of Natarajan came a day after Hazare and other representatives of the civil society boycotted a scheduled meeting but made it clear that they would participate in future meetings.

Congress leader Pranab Mukherjee is the Chairman of the Committee and former Law Minister Shanti Bhushan is its co-chairman.Natarajan also tried to drive a wedge between Hazare and Ramdev, saying the Gandhian appears to be unaware of the call for armed rebellion given by the Yoga Guru.Natarajan dismissed as "unacceptable" Hazare's statement that what he was fighting the "second freedom struggle".

Government spokesperson on Sunday justified police action to end Ramdev's agitation saying the Yoga Guru had violated the undertaking for permission and had even backed out on his assurances.Union Minister Kapil Sibal, explained that there were apprehensions about law and order situation in Delhi as Ramdev had collected 50,000 people for "political aasan" (manoeuver) although he had sought permission for a yoga camp for a gathering of 5,000 only. "It was not a Yoga platform, but a political platform. The law and order had to be enforced in Delhi. We did not want any disruptions in that," he told reporters. To a question, he said the party and the government were united on the police action."Absolutely 100 per cent. No such action takes place without 100 per cent unity in the government and the party," the minister said.He rejected BJP's allegations that the crackdown was reminiscent of Emergency. Sibal alleged that Ramdev was in league with the RSS as he referred to the presence of Sadvi Ritambhara in his protest. Speaking in the same vein Union Minister Subodh Kant Sahay said that discussions were being held with Ram Dev for more than 20 days and the government's intentions were clear on tackling the issue of corruption and black money. The Union Minister Kail Sibal said Ramdev was not a trustworthy person as he had "cheated" the government and also his followers."He reached an agreement with the government but did not tell it to his followers," Sibal said.He said government and Ramdev had reached an understanding as per which the Yoga Guru was supposed to announce calling off his strike by Saturday afternoon, but he did not honour the commitment."Despite assurances he did not make the announcement. We were in touch with him over phone. We waited till 5 pm. When he did not give statement we decided to go to press. We told him that," Sibal explained, referring to making public the letter written by one of his close associate. "If he backs out, how will we trust him," the Minister questioned.Congress leader Digvijay Singh justified the action against Baba Ram Dev. Mr. Singh accused him of inciting people despite striking a deal with the government for ending his protest. Mr. Singh also demanded an inquiry into the thousands of crores of rupees of property owned by Ram Dev. Senior party leaders held a high level meeting sunday evening at the residence of party president Mrs. Sonia Gandhi.Briefing reporters after the meeting, party spokesperson, Mr. Janardan Dwivedi said in New Delhi that the party discussed the current situation and decided to direct all the party workers to make people aware about the works done by central and party led state governments for people's benefit, so that the strategy of opposition parties could be foiled.

"Home Minister P Chidamabaram has replaced General Dyer, who had massacred peaceful agitators in Jallianwala Bagh during the freedom struggle," BJP president Nitin Gadkari told a dharna at the Raj Ghat here.
"Yesterday's incident has put a blot on the democracy in the country. Do people not have rights to agitate? Chidamabaram is the new Dyer in the country," he said.BJP President also accused the Home Minister of playing a key role in the 2G spectrum scam, saying "this man has made a lot of money.

BJPis holding peaceful protests across the country against the crackdown on Baba Ramdev's agitation and to meet President Pratibha Patil to demand convening of a special session of Parliament to discuss the issue."We would seek the intervention of the President. We would meet her this evening. L K Advani had yesterday said that the BJP will demand a special session of Parliament to discuss the issue," BJP chief spokesperson Ravishankar Prasad said.Advani, Gadkari, Sushma Swaraj, Arun Jaitley were among a host of leaders who were at the satyagraha site at Rajghat. The BJP on Sunday launched an agitation against the crackdown on Baba Ramdev's supporters and asked the government to bring back black money parked abroad.

Section 144 of CRPC in New Delhi district:

In an effort to pre-empt any protest by supporters of Baba Ramdev, Delhi Police on Sunday imposed prohibitory orders in New Delhi district where such agitations were apprehended."We have imposed section 144 of CRPC in New Delhi district," a senior police official said. The decision to impose prohibitory orders came in the backdrop of some followers of Ramdev camping at Jantar Mantar after they were ousted from the Ramlila Maidan where their congregation was disrupted by a mid-night police action. The official said police anticipated protest at India Gate, Boat Club or Jantar Mantar, places which fall in New Delhi district. With talks breaking down, police swooped down on Baba Ramdev a little past midnight and detained him after firing tear gas shells and resorting to lathicharge on his supporters. The dramatic police action came after government and the 46-year-old Yoga Guru had accused each other the previous night of betrayal on mutual assurances.

Baba Ramdev demands at glance

"Our agitation not against any political party or individual. We are neutral, not being sponsored by any party or organisation and people from all castes and religion are joining us. We appeal to all parties to join us. We are erecting a special stage where representatives from all parties can come to put forth their point of view," he said. Baba Ramdev announced of launch of his fast against corruption and to bring back black money stashed by Indians in foreign banks from June 4. Baba schedule of fast to start his fast from 7 AM on Saturday and continue till 9 PM."My fast will start from tomorrow (Saturday)," he told a huge gathering at the Ramlila ground in central Delhi."Corrupt people have no religion, they are demons. All corrupt ministers should be given the death sentence." He also claimed that his agitation was neither "politically motivated or communal" nor he has any "underground agenda" as was being portrayed by some sections.

His demands with details are:

Baba said to the Centre on the issue of land acquisition and claimed that he had already demanded that the Government amend the Land Acquisition Act, 1894.

Demanding that education in Indian languages be given priority so that the poor and maginalised sections of the society also benefit is encouraged then it will help the poor and the marginalised gain access to good schools and colleges. They will also be able to get quality education.

He also asked the Government to set up the National Farmers Commission and to ensure that organic farming and the usage of bio fertilizers are encouraged.
Baba Ramdev said that the judiciary was burdened with crores of cases and so would not be able to handle corruption and black money related cases.

"Our courts have a backlog of 3.5 crore cases and corruption and black money cases are being heard by the same courts. We should have separate courts to deal with corruption cases and exemplary punishment should be meted to the culprits. They should be given death sentence. They should be hanged to death," he said while addressing a mammoth gathering at Delhi's Ram Lila Ground on Friday.

"The issue of corruption is not a small one. If the entire black money is brought back to the country, then poverty will be abolished and India will prosper. Indian currency will be stronger than the dollar and pound. India was once the leader in every sphere of the world. It was economically most strong and had rulers who were virtuous. India taught the world about science, mathematics, geography and the universe. Now our country is at the bottom of every development index and at the top of corruption, population explosion, poverty and crime. This country is number one in corruption, lack of education, faltering health care facilities," said the yoga guru.He called people like Hasan Ali Khan who have stashed black money worth several crores in foreign bank as the enemy of the country.

Ramdev said that the slogan of his movement is: "Remove corruption, bring back black money." "There is a movement against corruption in the entire country and the entire country is joining hands. Our agenda is to bring back the black money and the country be saved from corruption. People inspired by this movement are fasting tomorrow. It is our constitutional right," said Ramdev.

“Today in this country, a troop of 10 crore people are directly connected with me. They are connected not because of any religious leaning, but because I have made them aware of the reality. I have been fighting against this corruption for the last five years. I have come here after walking one lakh kilometres. Ramdev has not dropped suddenly from the sky. He lives on the ground and has worked his way up from the grassroots level”, said Baba Ramdev.

He added, “According to my calculation, around Rs 400 lakh crore black money is stashed outside the country. Our country should get the money back. This is no small amount. It’s not just my opinion; it’s also the opinion of those who study the economy… Whenever people adopt the path of truth, others call them mad. At least people are not calling me mad. And what I’m saying will be proved right. You’ll see in the coming days that people who have committed these sins and have betrayed the nation will be exposed.”

Digvijay Singh said, “Baba Ramdev is a business man and not a sanyasi.” He added audaciously, “If Congress was scared, Ramdev would have been put behind bars. There is no fear; that is why he is out in the open and there are discussions with him”. This is not the first time Singh has tried to belittle the Yoga Guru. A Christian Congress MP from Arunachal Pradesh called Baba a ‘Bloody Indian’. Then, Rashid Alvi attempted to insult Baba Ramdev by commenting on the huge preparations going on at the fast venue.

Mayawati announces new land acquisition policy

Nksagar-Sagar Media Inc: New Delhi:
Mayawati Government in UP on farmers' agitation, on Thursday announced a new land acquisition policy under which its role in acquiring land for private developers would only be that of a facilitator. The chief minister, who held a farmers' Panchayat earlier in the day to discuss their problems, announced that the new policy will be implemented with immediate effect.Facing flak over acquiring land for private companies, the government has decided that from now on, the developers would be acquiring land directly from the farmers.

The chief minister also said that such acquisitions could only happen with the agreement of 70 per cent of the farmers in a given area. In case of disagreement, the project would be reviewed, she said.

Giving details of the new policy, she said that in the affected villages where land has been acquired, the developer would have to construct a kisan bhawan as well as a model school.

The chief minister clarified that areas where land has already been acquired and compensation distributed to farmers including Bhatta-Parsaul and Tappal will be out of the ambit of the policy.

Mayawati said the new policy has been framed to safeguard the interest of farmers, adding that their suggestions during the day-long panchayat in Lucknow, would be incorporated in the government order.

Terming the new policy a historic one, she said efforts would be made to get it implemented at the national level as the Union government also plans to bring a land acquisition bill during the monsoon session.

She stuck to her threat of protesting outside Parliament if the Centre failed to bring a new bill in the monsoon session.

This policy is even better than the ones being implemented in Congress-ruled states like Haryana, she claimed.

Blaming the Opposition for instigating the recent agitations, she said that instead of putting pressure on the Centre to amend the existing policy, they enacted a "drama" in UP and created a law and order problem at some places in the state.

The chief minister said an assurance has been given to representatives from Bhatta-Parsaul that the government would compensate the damages.According to the new policy, Mayawati said that for purposes including National Highways, canals or other basic amenities, land acquisition would be through mutual agreement and farmers would get the benefits of state's rehabilitation and relocation policy.

For setting up power and other projects, private companies would be negotiating directly with the farmers with the government just playing the role of a facilitator. She said two options would be given to farmers, adding that they can either take 16 percent of the developed land along with annuity of Rs 23,000 per acre for 33 years or take cash for some portion of the 16 percent land.
Farmers would also have the option of taking a one-time payment in case they do not want annuity which otherwise would be paid in July with a hike of Rs 800 annually.
Exemption on stamp duty will be given to farmers, she said adding that one member of the farmers' family being displaced, would get a job as per his qualification in the company.
